 2021 AMAF FOUNDATION SURVEY SWEEPSTAKES (“Sweepstakes”)

Sponsor: American Medical Association Foundation (“AMAF”)

 

1. NO PURCHASE NECESSARY TO ENTER. Sweepstakes begins at 12:01 a.m. Central Standard Time on September 1, 2021 and ends at 11:59 p.m. Central Standard Time on October 31, 2021 (“Sweepstakes Period”). 

2. HOW TO ENTER. To enter, complete the entire survey and return completed survey to 330 N. Wabash Avenue, Suite 39300, Chicago IL 60611. Entries must be received during the Sweepstakes Period to be entered into the Sweepstakes. Entries must be received by 11:59 p.m. Central Standard Time on October 31, 2021 (“Deadline”).  Only one entry per entrant will be permitted.  No copies, computer generated, mechanically reproduced, illegible, or incomplete entries will be accepted.  Sponsor is not responsible for lost, late, illegible, misdirect, mutilated, incomplete, or postage-due mail/entries.  Entrant is responsible to keep Sponsor advised of any change of email, mailing address and/or telephone number of entrant.  All card entries must be received before the Deadline to be eligible for the Sweepstakes.  All entries will become the property of the Sponsor and will not be returned.

3. ALTERNATE ROUTE TO ENTER. As an alternate method of entry, on a plain 3″x 5″ card, legibly hand-print “2021 AMA Foundation Survey Sweepstakes” and your name, phone number (including area code) and email address. Then, mail your 3″x 5″ card in a first-class, stamped envelope to the American Medical Association Foundation, Attention: ‘2021 AMA Foundation Survey Sweepstakes,’ 330 N. Wabash, Suite 39300, Chicago, Illinois 60611.  Only one entry per person will be permitted.  No copies, computer generated, mechanically reproduced, illegible, or incomplete entries will be accepted.  Sponsor is not responsible for lost, late, illegible, misdirect, mutilated, incomplete, or postage-due mail/entries.  Entrant is responsible to keep Sponsor advised of any change of email, mailing address and/or telephone number of entrant.  All card entries must be received before the Deadline to be eligible for the Sweepstakes.  All entries will become the property of the Sponsor and will not be returned.

4. DRAWING/PRIZE. A total of one (1) prize will be awarded.  One (1) individual prize winners will be selected from a total number of valid entries received.  Each winner will be randomly selected in a drawing to be conducted on or by December 15, 2021 around noon Central Standard Time by the Sponsor at Sponsor’s headquarters premises in Chicago, Illinois.  The number of prize winners, and the prizes (including approximate retail value) are as follows:

The total value of the prizes (ARV):  $100.00 USD.   The prizes are not transferable and no substitutions will be made.  All taxes on the prize are the responsibility of each winner.  All expenses not specified, including any expenses associated with use of the prize, are the prize winner’s sole responsibility.  The Sponsor makes no representation, or guarantee, express or implied, in fact or in law, relative to the prize.  The winners will be selected by a random drawing from among all eligible entries.  Odds of winning will be determined by the total number of valid entries received.

5. ELIGIBILITY. The Sweepstakes is open to any medical student and/or physician licensed by an appropriate jurisdiction in the United States, 18 years of age and older, a legal resident of the United States.  All other persons are not eligible to enter this Sweepstakes including employees of the Sponsor or its affiliates, exhibitors, vendors or their employees and family members. 

6. INTERNET. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programing associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries in the Sweepstakes.  The following Sweepstakes is intended for play in the United States only and shall only be construed and evaluated according to United States law.  Do not enter this Sweepstakes if you are not located in the United States. Void where prohibited.  Multiple entries per person per week, including multiple entries by the same entrant using different email addresses, will invalidate ALL entries submitted by the entrant for the entire promotion period.

Sponsor reserves the right, in its sole discretion to cancel or suspend this Sweepstakes, and randomly award the prizes from among all eligible entries received prior to action taken by Sponsor, should fraud, virus, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the game.  Sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature. 

Should multiple users of the same e-mail account enter the Sweepstakes and a dispute thereafter raise regarding the identity of the entrant, the authorized subscriber of said e-mail account at the time of entry will be considered the entrant.  “Authorized account subscriber” is defined as the natural person who is assigned an email address by an Internet access provider, on-line service provider or other organization which is responsible for assignment e-mail address or the domain associated with the submitted e-mail address. Any potential winner may be requested to provide Sponsor with proof that such winner is the authorized account holder of the email address associated with winning entry. 

All entrants must have a valid E-mail address.  Sponsor reserves the right at its sole discretion, to disqualify any individual (and all of his or her Sweepstakes entries) who tampers with the entry process.  Automated entries are prohibited, and any use of such automated devices will cause disqualification.

7. RELEASES/DISCLAIMER. By participating in this Sweepstakes, entrants agree to release Sponsor, and any other organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of this Sweepstakes (such as, not limited to, the manufacturer of the prize, and any social media outlets that Sponsor may use to promote the Sweepstakes including, but not limited to, Facebook and Twitter), and each of the respective parents, agents, affiliates, subsidiaries, advertising and promotion agencies and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns from any and all actions, claims, injury, loss or damage arising in any manner, in whole or in part, directly or indirectly, from participation in this Sweepstakes and/or acceptance or use of the prize. Entrants acknowledge that this Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, the manufacturer or supplier of the prize, and/or any social media outlet used to promote this Sweepstakes, including, but not limited to, Facebook and Twitter.  Entrants agree to be bound by these Official Rules and the Sponsor’s decisions.  This Sweepstakes is subject to all applicable federal, state and local laws and regulations.

By participating in this Sweepstakes entrants (a) warrant and represent that any person portrayed in a submission has given his/her consent to entrant to publish the person’s likeness and/or if a person portrayed is a minor, the entrant has secured the consent of the person’s parent or legal guardian; (b) grant to AMAF the unlimited, perpetual right to reproduce, display and distribute the submission (or any portions thereof) for purposes consistent with AMAF’s missions and objectives as AMAF  may decide in its sole discretion, in all media now or hereafter known.  This includes AMAF or its agents posting or arranging for the posting of the submission on the Internet for potential worldwide distribution and viewing; (c) grant AMAF all ownership in the submission, including copyright.

By entering, entrants agree that (a) all issues and question concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligation, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Illinois, without giving effect to any choice of law or conflict of law rules; (b) that personal information provided by entrants or winners on Sweepstakes-related documents may be used, published or processed as outlined in the American Medical Association Privacy Policy website, as updated.  By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Cook County Illinois. 

8. GENERAL. All prizes will be awarded.  The winner does not need to be present at the time of the drawing.  Winners will be contacted by the Sponsor. The winners of the Sweepstakes will be required to sign and return to the Sponsor Affidavit of Eligibility and Liability/Publicity Release Form before receiving the prize.  Refusal or failure to sign and return the Affidavit of Eligibility and Liability/Publicity Release Form within 14 days from first attempted notification will result in foreiture of the prize.  Except where prohibited by law, acceptance of the prize constitutes winner’s consent to use his/her name, likeness, and biographical data for AMAF promotional purposes without additional compensation.  All federal, state and local laws apply.  Void where prohibited by law. The decisions of the AMAF on this Sweepstakes are final.

At the time of the drawing, extra alternate winners will be selected.  Such alternate winners may receive a prize if the originally selected winner is disqualified or otherwise determined to be ineligible.  If any correspondence of the Sweepstakes or any prize is returned as undeliverable, the corresponding prize will be forfeited and will be awarded to an alternate winner.  Should a winner make any false statement(s) in any document referenced above, the winner will be required to promptly return to Sponsor his/her prize.  Any unclaimed prizes will be awarded in a random drawing to be held as necessary.  In the event there is a dispute of the entrant’s identity, the prize will be awarded to the established email account associated with the entry. 

The Sponsor, its directors, employees or agents are not responsible for errors, problems or malfunctions relating to or in connection with the Sweepstakes, including without limitation, errors, problems or malfunctions which may occur in connection with the administration of the Sweepstakes, the announcement of the prizes, the processing of entries or in any Sweepstakes-related materials; or for transactions that are lost, misdirected, or fail to enter into the processing system for any reason; or are processed, reported, or transmitted late or incorrectly; or are lost for any reason, including computer, telephonic, paper-transfer, or human error, or electronic, computer, or telephonic malfunction, damage, error, omission, interruption, defect, delay in operation or transmission, or any combination thereof. Any and all warranties and/or guarantees on a prize (if any) are subject to the respective manufacturers’ terms therefor, and the winner(s) agrees to look solely to such manufacturer(s) for any such warranty and/or guarantee. 

As a condition of entering, entrant(s) agree: (a) to release Sponsor, its affiliates, retailers, sales representatives, distributors, and each of their officers, directors, employees, representatives and agents from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession, and/or use or misuse of any prize, (b) under no circumstances will entrant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages; (c) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs.

11. PRIVACY: Sponsor will be collecting personal data about entrants in accordance with its privacy policy. Sponsor’s privacy policy can be viewed at https://amafoundation.org/privacy-policy/.  By participating in the Sweepstakes, you hereby agree to Sponsor’s collection and usage of your personal information (if any) and acknowledge that you have read and accepted Sponsor’s privacy policy.

12. Legal Warning. ANY ATTEMPT BY AN individual, whether or not an ENTRANT, TO DELIBERATELY interfere with the OPERATION OF THE SWEEPSTAKES, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS and THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES and diligently pursue all remedies against ANY SUCH individual TO THE FULLEST EXTENT PERMITTED BY LAW.  WITHOUT LIMITING THE FOREGOING, ENTRANTS FURTHER AGREE THAT THE SPONSOR, THE AMERICAN MEDICAL ASSOCIATION FOUNDATION, ITS AFFILIATES, ADVERTISING AND PROMOTION AGENCIES, PRIZE SUPPLIERS, AND THEIR RESPECTIVE  OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, REPRESENTATIVES, AGENTS, SUCCESSORS AND ASSIGNS, SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, COSTS OR EXPENSES, OF ANY KIND, ARISING FROM OR RELATED TO CIRCUMSTANCES BEYOND THE REASONABLE CONTROL OF SPONSOR, THE AMERICAN MEDICAL ASSOCIATION AND/OR ITS AFFILIATES, ADVERTISING AND PROMOTION AGENCIES, PRIZE SUPPLIERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, REPRESENTATIVES, AND AGENTS, INCLUDING BUT NOT LIMITED TO ACTS OF GOD, ACTS OF GOVERNMENT, ACTS OF TERROR, ACTS OF WAR, CIVIL UNREST, LABOR SHORTAGES AND/OR STRIKES, EVEN IF ANY ONE OR MORE OF THE PROMOTION PARTIES OR ANY OF THE OTHER RELEASED PARTIES WERE AWARE OF THE POSSIBILITY OF ANY SUCH EVENTS OCCURRING.
