DMCA Policy

AMA Foundation ("we," "us," or "our") respects the intellectual property rights of others and expects users of amafoundation.org (the "Site") to do the same. We respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.

Reporting Alleged Infringement

If you believe that material accessible on or from the Site infringes your copyright, you may request removal of that material (or access to it) by submitting written notification to our Designated Copyright Agent. In accordance with 17 U.S.C. § 512(c)(3), the notice must include:

1.      A physical or electronic signature of a person authorized to act on behalf of the copyright owner.

2.     Identification of the copyrighted work claimed to have been infringed.

3.     Identification of the material claimed to be infringing, with information reasonably sufficient for us to locate it (URL preferred).

4.     Your contact information (address, telephone number, and email address).

5.     A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.

6.     A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification

If you believe material that was removed (or to which access was disabled) is not infringing, or that you have authorization from the copyright owner, the copyright owner's agent, or the law to post and use the material, you may send a counter-notification to our Designated Agent. Pursuant to 17 U.S.C. § 512(g)(3), the counter-notification must include:

1.      Your physical or electronic signature.

2.     Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.

3.     A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.

4.     Your name, address, and telephone number, together with a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, the U.S. District Court for the Northern District of Illinois), and that you will accept service of process from the person who provided the original notification or that person's agent.

Upon receipt of a valid counter-notification, we may restore the removed material in not less than 10 nor more than 14 business days, unless our Designated Agent first receives notice from the original complainant that the complainant has filed an action seeking a court order to restrain the alleged infringer.

Repeat Infringer Policy

AMA Foundation will, in appropriate circumstances, terminate the access of users who are determined to be repeat infringers.

Modifications

AMA Foundation reserves the right to modify this DMCA Policy at any time. Material changes will be reflected by an updated effective date below.
